Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Browse Botswana (“BB”), a private, independently owned online directory. By accessing or using BB, including all platforms, content, and services, you agree to these Terms, along with the incorporated Privacy Policy, Disclaimer, Refund & Cancellation Policy, and all site rules. If you do not agree, you are not authorised to use BB.

1. Eligibility and Acceptance

You represent that you are of legal age and capacity to use BB or are authorised to bind a business to these Terms. We may modify these Terms at any time. Continued use constitutes acceptance of any changes.

2. Scope of Services

BB is a listing and directory platform. We do not own, control, manage, or guarantee any listed service, event, business, product, or professional. All interactions and transactions are strictly between users and listers. We are not a party to any transaction.

3. Account Creation and Conduct

You agree to:

  • Provide truthful and accurate information
  • Keep login details confidential
  • Not misuse the platform, violate laws, or post prohibited content

Misuse includes, but is not limited to:

  • Creating fake or duplicate accounts
  • Scraping or harvesting data
  • Circumventing moderation or system security
  • Using automation or bots without permission

We reserve the right to suspend or terminate accounts for violations.

4. Listings and Content

You retain ownership of content you submit, but grant BB a global, irrevocable license to use, display, modify, or remove it. You warrant that your content does not:

  • Infringe third-party rights
  • Violate any laws
  • Mislead, defame, or endanger others

BB may moderate, reject, or remove content at its sole discretion.

5. Fees and Payments

Fees apply to premium listings, promotions, and upgrades. Payment is processed via third-party services (e.g. DPO). By paying, you:

  • Authorise charges including applicable taxes 
  • Acknowledge that all payments are non-refundable 
  • Accept our Refund Policy

BB does not store full credit card details.

6. Refund and Cancellation Policy

All fees paid to BB are final and non-refundable, even in cases of:

  • Lister disputes
  • Post moderation or removal
  • Event cancellations or listing issues

Disputes must be resolved directly between the user and the lister. BB is not liable for such outcomes.

7. Liquidated Damages

You agree to pay specific amounts for policy breaches, including:

  • P20 per data scraping violation
  • P15,000 for identity misuse or impersonation
  • P10,000 per prohibited content post
  • P45,000 per day for unauthorised use of BB content

These amounts reflect a reasonable estimate of BB’s damages and are enforceable under Botswana law.

8. Intellectual Property

BB trademarks, branding, code, design, and logos are protected. You may not:

  • Copy, resell, or modify BB code/content 
  • Frame or mirror the site without permission 
  • Infringe on BB’s or third-party IP rights

9. Disclaimer and Limitation of Liability

BB is provided “as is” and “as available”. We:

  • Make no warranties or guarantees
  • Disclaim all liability for listings, users, or listers
  • Are not liable for any indirect, incidental, or consequential losses

If liability arises, it is limited to P1,000.00 or the amount paid in the past two months, whichever is lower.

10. Indemnity

You agree to indemnify BB against any claims, damages, or costs arising from your use of the platform, including from third-party claims related to your content, conduct, or listings.

11. Governing Law and Dispute Resolution

All claims will be governed exclusively by Botswana law. Any dispute shall be resolved at BB’s discretion by:

  • Binding arbitration in Gaborone, or
  • Litigation in the courts of Botswana

You will bear all associated legal and arbitration costs.

12. Prohibited Content and Activities

The following are prohibited (non-exhaustive list):

  • Firearms, explosives, and unlicensed drugs
  • Human trafficking, child exploitation
  • Fraud, scams, and impersonation
  • False, obscene, or defamatory posts
  • Counterfeit goods, illegal items
  • Multi-level marketing and pyramid schemes

BB may modify this list without notice.

13. Trademarks

“BROWSE BOTSWANA”, “BB” and associated marks and logos are protected trademarks registered or to be registered with the relevant trademark authorities.

14. Entire Agreement and Severability

These Terms, along with incorporated policies, form the full agreement between you and BB. If any provision is found unenforceable, it will be limited or replaced to reflect the original intent as closely as possible.
