Refund & Cancellation Policy

This Refund and Cancellation Policy forms part of the legal framework governing your use of Browse Botswana (“BB”). It must be read together with the Terms and Conditions of Use, Disclaimer, and Privacy Policy.

1. General Principle

All payments made to BB are final and non-refundable, unless expressly stated otherwise in this policy. By using the platform and making any payment, you confirm that you understand and agree to this policy.

2. Scope

This policy applies to all payments made to BB, including but not limited to:

  • Listing placement fees
  • Paid promotions and feature upgrades
  • Commission payments related to transactions
  • Event listings or ticketing service fees paid to BB

3. Cancellations by Listers

Cancellation of a listing, service, or event by a lister does not entitle the user or attendee to a refund of any fee paid to BB. BB acts solely as a listing and directory platform and is not responsible for the actions or service delivery of listers.

Users must resolve any refund or cancellation issues directly with the lister or service provider.

4. Platform Moderation or Removal

Payments remain non-refundable even if:

  • A listing is removed or modified due to content policy violations
  • A listing is suspended, re-categorised, re-ranked, delayed, or omitted
  • An event is cancelled or rescheduled by a third-party lister

5. Fraud, Abuse, or Breach

No refund will be issued if the user or lister is found to have:

  • Violated any part of the Terms and Conditions of Use
  • Submitted fraudulent, abusive, or misleading content
  • Abused platform systems or user trust

6. Technical Issues and Platform Errors

In the event of a technical error caused solely by BB that prevents the completion of a payment or the publication of a listing, BB will issue a full refund or corrective credit at its sole discretion. Refunds will only be issued where BB is directly responsible for the error and cannot remedy it within a reasonable time.

7. Warranties and Limitations of Liability

BB does not guarantee the continuous availability, accuracy, or performance of the platform. To the fullest extent permitted by law, all services are provided “as is” and “as available” without warranties of any kind, whether express or implied.

BB shall not be liable for:

  • Any indirect, incidental, special, or consequential losses
  • Loss of revenue, profits, business opportunities, or goodwill
  • Delays, listing errors, or failures caused by third parties

If liability is imposed despite this exclusion, it shall be limited to BWP P250.00 or the commission received for the affected transaction, whichever is lower.

8. Governing Law and Dispute Resolution

This policy is governed by the laws of the Republic of Botswana. Any dispute shall be resolved according to the Dispute Resolution clause in the Terms and Conditions of Use, at BB’s discretion by:

  • Binding arbitration in Gaborone, Botswana, or
  • Litigation before the competent courts of Botswana

All legal or arbitration costs shall be borne by the user.
