This Disclaimer applies to all users of the Browse Botswana platform, including but not limited to visitors, customers, listers, vendors, event hosts, service providers, advertisers, and business owners.

1. Definitions

For the purposes of this Disclaimer:

  • “Browse Botswana”, “we”, “our”, or “the platform” refers to the business operating the website browsebotswana.com.
  • “User”, “you”, or “your” refers to any person who visits, views, interacts with, lists on, or advertises through the platform.
  • “Lister” means any person or entity submitting a business, event, property, legal service, product, or service listing.“Content” includes listings, advertisements, reviews, links, text, media, and any submitted or visible material.
  • “Service” refers to the display and publication of listings on the platform.

2. Platform Role and Limitation of Responsibility

Browse Botswana is an independent, neutral online directory. The platform does not own, manage, operate, control, or guarantee any business, service, event, legal provider, experience, property, or product listed on the website. The role of the platform is strictly limited to publishing listings and facilitating visibility.

Browse Botswana does not act as an agent, broker, intermediary, representative, or employer of any lister, and assumes no legal or commercial responsibility for any transaction or engagement between users and listers.

3. No Endorsement or Guarantee – Including Verified Listings

The presence of a listing on the platform, including those marked as “Verified”, “Featured”, or similar, does not constitute any endorsement, recommendation, or guarantee by Browse Botswana. Verification only indicates that certain administrative criteria were met at the time of listing. It does not imply investigation, audit, accuracy, reliability, legal compliance, or quality. Users must exercise independent judgment and conduct their own due diligence before engaging with any listing.

4. No Responsibility for Transactions or Disputes

Browse Botswana is not responsible for:

  • The accuracy, legality, or quality of any listing;
  • The acts, omissions, representations, failures, or breaches by any lister;
  • Any communication, transaction, booking, product, or service arising from the platform

All disputes, claims, and complaints arising from listings or interactions must be resolved directly between the user and the lister. The platform has no obligation to intervene in or facilitate any dispute resolution.

5. No Refunds or Chargebacks

All payments, commissions, placement fees, or listing charges paid to Browse Botswana are nonrefundable. By using the platform, you waive any right to seek a refund, chargeback, reversal, or similar claim, regardless of the result of any transaction or listing-related issue.

All issues related to pricing, services, products, events, bookings, or disputes must be directed to the relevant lister.

6. Acceptance of Terms

By using the platform, you confirm that you:

  • Have read, understood, and agreed to this Disclaimer;
  • Agree to be legally bound by the Disclaimer, the Terms and Conditions of Use, the Privacy Policy, and the Refund Policy;
  • Will not use the website if you disagree with any of these documents.

7. Indemnity

You agree to fully indemnify, defend, and hold harmless Browse Botswana, its owner, employees, contractors, and affiliates from and against any claims, damages, losses, penalties, fines, expenses, legal fees, and liabilities arising from:

  • Your use of the platform or reliance on any listing;
  • Your engagement with a lister;
  • Your breach of any policy, agreement, or applicable law;
  • Any harm caused to another person through your use of the platform.

8. Limitation of Liability

To the fullest extent permitted by law, Browse Botswana shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, opportunity, revenue, business, data, goodwill, or any injury or death.

If any liability is found to exist despite this exclusion, it shall be strictly limited to the lower of:

  • BWP P250.00, or
  • The actual commission received by Browse Botswana for the relevant transaction or listing.

9. Governing Law

This Disclaimer is governed by and shall be construed in accordance with the laws of the Republic of Botswana. In interpreting this Disclaimer, persuasive authority may be drawn from RomanDutch law, South African law, and English common law to the extent such authorities do not conflict with Botswana statutes or judicial decisions.

10. Dispute Resolution

All legal or contractual disputes shall be resolved, at the sole discretion of Browse Botswana, by either:

  • Binding arbitration seated in Gaborone, Botswana; or
  • Litigation before a competent court in Botswana.

The user shall be responsible for all legal, arbitration, and associated costs, including those incurred by Browse Botswana, regardless of outcome.

By using the platform, you waive any right to class actions, punitive damages, or foreign jurisdiction.
